Introduction
This web site, all its contents as well as the rights pertaining to them are the exclusive property of ¿adónde? Any duplication partial or total must be authorized by the owners. On the other hand, Any links to this website are authorized without previous authorization. 1. Acceptance of terms and conditions The customer acknowledges to have read, understood and accepted our terms and conditions on this screen during purchase and agrees to them without reservations. These terms and conditions define the business transaction -- act of sale and purchase -- between ¿adónde? and its customer. Both parties accept them wholly. 2. Products Are excluded from the contractual bond, pictures and illustrations of the products. ¿adónde? is not responsible for any errors that might appear in the pictures and illustrations concerned. Most products in our catalogue are available from our warehouse. 3. Order The automatic recording systems whereby orders are registered are proof of the nature and content of any and all orders. ¿adónde? will validate and accept a customer's order via the e-mail address that he/she provided. The sale is completed upon validation of the order. ¿adónde? has the right to cancel any order from a customer with whom there's a current dispute regarding payment on previous orders. The customer is responsible for the information provided upon ordering. Should there be any errors in the customer's name and/or address, ¿adónde? will not be held responsible before the difficulty or impossibility to deliver the ordered products. 4. Delivery The customer is committed to paying all taxes and customs related to the importation of products in their country of residence. All orders placed to ¿adónde? are meant for the customer's personal use. The customer or recipients of these orders cannot resell ¿adónde? products partially or totally. ¿adónde? cannot be held juridically responsible should the customer not pay taxes and customs in their country. Orders in mainland France and in the European Community (EC) are delivered by La Poste via the Colissimo service. Delivery times are the carriers' full responsibility and ¿adónde? cannot be held responsible for La Poste non-compliance with delivery times. Any further delay do not entitle the customer to compensation. War, rioting, fire, industrial action, accidents and the inability to procure goods are deemed to be force majeure grounds that discharge the vendor from the obligation to deliver. The goods are always carried at the recipient's risk. Goods should always be checked upon delivery. If goods are incomplete or damaged, the customer has 48 hours to notify the carrier. For reasons of availability, an order may be delivered to the customer in several parts. In this case the customer pays only for one delivery. If the customer wishes the order to be delivered to two addresses, he shall place two orders and pay for two deliveries accordingly. 5. Return The customer has seven days from the day of reception of goods to return them. Whether the customer wishes an exchange or reimbursement, he/she has to send the undamaged products in their original packing condition to the following address: ¿adónde? 8 rue Lemercier 75017 Paris France ¿adónde? will reimburse the customer's payment without charges except for those to do with the return shipping fees. Reimbursement will be done within fifteen days. 6. Price Prices are stated in euros. Prices indicated in product pages do not include shipping. The price stated in the order confirmation is final and inclusive of all duties and taxes, and VAT for France and other EU countries. This price includes products, handling and shipping. 7. Payment The price on the invoice is the same price as in the order confirmation sent to the customer by ¿adónde?. Payment is due the day the order takes effect. Payment is done through the PayPal system. In France, customers may also pay by cheque in EUROS to ¿adónde?. In this case, the customer's address and the order number must be written on the back of the cheque. The order will be processed upon reception of the cheque. ¿adónde? accepts bank wire transfers. Any charges related to these bank wire transfers must be paid by the customer. ¿adónde? will only take into account the exact amount of money transfered to its bank account. In addition, ¿adónde? has the right to refuse any order coming from a customer with whom there is a case under dispute. 8. Dispute The current terms and conditions are governed by French law. In case of dispute, only the Paris courts are competent to deal with such matters. 9. Guarantee ¿adónde? guarantees that all of its products are made in France, Spain, Italy or Nicaragua. ¿adónde? cannot be held responsible for non-compliance, should the products not meet the norms and legislations of a customer's country. In any case, ¿adónde? is responsible only up to the product's value the day of purchase. The customer has no legal recourse against the product's brand or the manufacturer. 10. Legal Information The customer must provide his/her personal data for the sale to take place. Such information is required to process, invoice, send and guarantee the order. Failure to provide the required information will systematically cancel any order. The use of personal data is protected by French law and has been the object of a declaration to the "Commission Nationale de l'Informatique et des Libertés" (CNIL). The customer has accordingly the right to access to, change, correct and delete the information he/she has provided (article 34, law from january 6th, 1978). In addition, ¿adónde? commits to not releasing such information to any third party be it free of charge or not. |
